Sydney IT company and director face court
The Fair Work Ombudsman has commenced legal action against a Sydney information technology company and its owner-operator for an alleged breach affecting an international student.
Facing court are Enterprise CRM Solutions (Holdings) Pty Ltd and the company's sole director and shareholder Ben Horin. The company provides IT consulting services in areas including data and systems support.
The Fair Work Ombudsman investigated after receiving requests for assistance from two workers the company employed as a legal analyst and a data analyst on a casual basis at different times between December 2024 and April 2025.
One of the workers was a Spanish international student.
A Fair Work Inspector issued a Compliance Notice to the company in February 2026 after forming a belief the company had failed to pay the workers any wages for the work they performed. It is alleged that the international student was not paid for 149.51 hours of work and the other worker was not paid for 23.75 hours of work.
The Inspector formed a belief that the workers were entitled to be paid minimum wages, including casual loading, under the Miscellaneous Award 2020.
The Fair Work Ombudsman alleges the company, without reasonable excuse, failed to comply with the Compliance Notice, which required it to calculate and back-pay the workers' entitlements.
It is alleged that the amount the company was required to pay to comply with the Compliance Notice was $5,081, including $4,385 for the international student and $696 for the other worker.
It is alleged Mr Horin was involved in the contravention.
Fair Work Ombudsman Anna Booth said the regulator would continue to enforce workplace laws and take businesses to court where lawful requests were not complied with.
"Where employers do not comply, we will take appropriate action to protect employees," Ms Booth said.
"Employers should be clear that, if a court finds a breach, they can face both penalties and orders for payments for the workers.
"Protecting visa holder workers is a priority for us. Any employees with concerns about their pay or entitlements should contact us for free advice and assistance. They can also contact their union if they are a member."
The Fair Work Ombudsman is seeking penalties in court for the alleged failure to comply with the Compliance Notice. Enterprise CRM Solutions (Holdings) Pty Ltd faces a penalty of up to $99,000 and Mr Horin faces a penalty of up to $19,800.
The regulator is also seeking a court order requiring the company to comply with the Compliance Notice, including rectifying any outstanding entitlements, plus superannuation and interest.
A directions hearing is listed in the Federal Circuit and Family Court in Sydney on 26 October 2026.
In 2024-25, the FWO secured total court penalties of more than $870,000 for failures to comply with Compliance Notices.
The Fair Work Ombudsman filed 171 litigations against employers involving visa holder workers, and secured $39 million in penalties in cases that have included visa holder workers, in the eight financial years to June 2025.
