In October 2021, the ABCC began court proceedings alleging that James Darnton-Turner and Brian Windsor, and through them the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing And Allied Services Union, breached section 500 of the Fair Work Act while the two officials were exercising entry rights as permit holders at the Founders Lane project site.
