Director faces court over alleged $20,000 underpayment of call centre employee

The Fair Work Ombudsman has launched a prosecution against the former director of a medical services business over an alleged $20,000-plus underpayment of a call centre worker.
Facing court is Jacov Vaisman, who was formerly the sole director of two companies that traded as Advanced Medical Institute (AMI), a business which offered services for addressing sexual dysfunction and prostate problems.
Documents lodged in the Federal Magistrates Court in Sydney allege Mr Vaisman was centrally involved in underpaying a Sydney call centre employee $22,942 between October, 2006 and October, 2008.
The employee was engaged on a casual basis as an ‘appointment booker’, which involved receiving inbound telephone calls and setting bookings for AMI.
He was allegedly underpaid penalty rates for weekend, night and public holiday work, shift work allowances, overtime pay and meal-related entitlements.
Fair Work Ombudsman Executive Director Michael Campbell says the decision to prosecute Mr Vaisman was made because of the significant amount involved and the employer’s failure to rectify the matter.
The two companies that traded as AMI - AMI Holdings and Advanced Medical Institute Pty Ltd - have gone into administration, which prevents the Fair Work Ombudsman from prosecuting them.
The Fair Work Ombudsman alleges Mr Vaisman was involved in several breaches of workplace laws.
He faces maximum potential penalties of $6600 per breach.
A directions hearing is scheduled for August 9.
