Sydney director fined $12,000 for underpaying 21-year-old receptionist

The former director of a Sydney company has been fined $12,000 over the underpayment of a young worker following a prosecution by the Fair Work Ombudsman.

The Chief Industrial Magistrate’s Court in Sydney imposed the penalty against Anastasia Kelly, who was controller and sole director of Baulkham Hills-based Recruit (NSW) Pty Ltd.

Chief Industrial Magistrate Gregory Hart found Kelly was involved in the underpayment of a 21-year-old receptionist and the company’s failure to produce employment records.

The receptionist was underpaid a total of $5072. She was underpaid her minimum hourly rate, personal leave entitlements and accrued annual leave was withheld when she left the company.

Chief Industrial Magistrate Hart ordered that part of Kelly’s fine be back-paid to the receptionist, who is still owed some money, within 28 days.

Fair Work Ombudsman Executive Director Michael Campbell says the case sends a strong message to the community that the underpayment of young workers is a serious matter.

The Fair Work Ombudsman discontinued its prosecution against Recruit (NSW) Pty Ltd after the company went into liquidation earlier this year. The company provided serviced and virtual offices.
