Security company faces court for allegedly underpaying Sydney guards $135,000
The Fair Work Ombudsman has launched a prosecution against a NSW security company for allegedly underpaying 11 guards in Sydney more $135,000.
One of the guards was allegedly underpaid more than $25,000.
Facing court is Reflections Security Pty Ltd, which has an office in Castle Hill.
Documents lodged in the Federal Magistrates Court in Sydney claim the company underpaid the workers between 2006 and 2009.
The security guards were allegedly underpaid annual leave entitlements, allowances, the minimum hourly rate and penalty rates for weekend, overtime and public holiday work.
Reflections Security also allegedly failed to pay compensation to three of the guards after their workplace agreements failed the Fairness test.
Inspectors found the alleged underpayments when they investigated complaints by workers last year.
Fair Work Ombudsman Executive Director Michael Campbell says the decision to prosecute was made because of the significant amount involved and the company’s failure to rectify the matter.
The Fair Work Ombudsman alleges the company committed several breaches of workplace laws.
The Agency is seeking penalties against the company and a Court Order for the company to back-pay the guards the money allegedly owed.
The maximum potential penalty per breach is $33,000. The case is listed for a directions hearing on February 11.
