There are new wages for some social and community services (SACS) employers in Queensland. They may also need to pay employees back pay.
These changes, made in the new Fair Work (Transitional Provisions and Consequential Amendments) Amendment Regulation 2012 (No. 1) (the Regulation), start on 1 March 2012.
The new rates of pay are in a schedule to the Regulation, available below.
Employers who this applies to
The Regulation covers employers that:
- were not constitutional corporations (essentially in this sector this means that they were not ‘trading’ corporations) immediately before 1 January 2010
- were covered by a federal transitional award immediately before 1 January 2010
- are covered by the Social, Community Home Care and Disability Services Industry Award 2010 (the modern award) from 1 January 2010, and
- received money from the Queensland Government following the QIRC Order of 12 June 2009, for employees in the SACS sector.

The Government has committed $30 million to help eligible employers meet their back pay obligations. See the Department of Education, Employment and Workplace Relations (DEEWR) funding fact sheet below for information about timing and eligibility.
