Personal/carer’s and compassionate leave entitlements under the Australian Fair Pay and Conditions Standard (the Standard) applied up to and including 31 December 2009 and were generally the same as those under the NES, with the following exceptions:
- There was no entitlement for unpaid compassionate leave for casual employees in the Standard - there is in the NES.
- An employee could take a maximum of 10 days of paid carer’s leave (regardless of an employee’s cumulative personal/carer’s leave balance) under the Standard - this limit does not apply under the NES.
- Under the Standard, requirements to provide notice and evidence did not apply to an employee who was unable to provide the notice or evidence because of circumstances beyond their control.
