Your security employees have an entitlement to be paid for a minimum number of hours if they are required to return to work (for any reason) after they have finished their shift.
The minimum entitlement depends on the reason for the call back and the day on which the work is performed.
| Monday to Saturday - for disciplinary and/or counselling interviews and/or administrative procedures such as completing Workers’ Compensation Forms, Accident Reports or Break/Entry reports |
2 hours |
| Monday to Saturday - for any reason other than those outlined above |
3 hours |
| Sunday - for any reason |
4 hours |
This entitlement does not apply to employees where the period of duty is continuous with the employee’s ordinary hours of work. For example, where an incident report is required to be completed before they leave work and they work additional time in order to complete it. Please note that overtime may be payable in these instances.
The rate that the employee is entitled to be paid (the appropriate rate), will depend on the time that they are working - for example the time worked due to a call back may be within ordinary time or it may be overtime, in which case it will attract the applicable overtime rate.
Example
Madeline is employed by SecTec Pty Ltd as a full-time security officer. Madeline generally works in the evenings, guarding business premises and private residences. After going home from a particular weekday evening shift, Madeline is called back to the office by her manager Sergio who advises her that there had been a ‘break and enter’ at the premises she was guarding, following her departure.
Madeline returns to the office and completes a Break/Entry Report, which takes her 1 hour to complete. This hour is in addition to her 38 ordinary hours of work. As Madeline was called back to work on a weeknight for the purposes of completing a Break/Entry Report, Madeline is entitled to payment for 2 hours at the overtime rate of pay.
