What types of businesses are covered by the Clerks Award?

The Clerks - Private Sector Award 2010 (referred to throughout these pages as the Clerks Award) covers employees performing mainly clerical and administrative work in the private sector, unless the business is in an industry covered by another modern award that has classifications for clerical employees. There are some other exceptions set out in clause 4 of the Clerks Award.

The following modern awards include classifications for clerical and administrative employees:

  • Alpine Resorts Award 2010
  • Animal Care and Veterinary Services Award 2010
  • Banking, Finance and Insurance Award 2010
  • Black Coal Mining Industry Award 2010
  • Business Equipment Award 2010
  • Contract Call Centres Award 2010
  • Educational Services (Post-Secondary Education) Award 2010
  • Educational Services (Schools) General Staff Award 2010
  • Fitness Industry Award 2010
  • General Retail Industry Award 2010
  • Health Professionals and Support Services Award 2010
  • Higher Education Industry-General Staff-Award 2010
  • Hospitality Industry (General) Award 2010
  • Legal Services Award 2010
  • Market and Social Research Award 2010
  • Rail Industry Award 2010
  • Restaurant Industry Award 2010
  • Sporting Organisations Award 2010
  • Telecommunications Services Award 2010

If your business is covered by any of these modern awards, then the terms and conditions of employment of your clerical and administrative staff will most likely be in that award and not the Clerks Award. If you need assistance working this out please call us.
