Applicants will be advised that their application has been received.
The Minister may refer the application to the Department for Education, Employment and Workplace Relations (DEEWR) for advice before deciding whether to make the declaration. The Minister or the Department may also seek further information or clarification on matters relating to the application.
Applicants will be advised in writing if the declaration is made.
Where a declaration is made, the relevant employers will be specified in the declaration.
The employers may then apply to Fair Work Australia (FWA) for a single interest employer authorisation in relation to the proposed enterprise agreement.
Single interest employer authorisation
The effect of a single interest employer authorisation is that the employers are single interest employers. This means:
- they can bargain together for a single enterprise agreement with access to the good faith bargaining provisions of the Fair Work Act 2009
- their employees will be able to take protected industrial action in support of claims for the proposed single enterprise agreement.
