Can I rely on pay rate calculations made using the Fair Work Ombudsman’s pay tools?
Employees will always be entitled to the minimum terms and conditions prescribed by the Fair Work Act and applicable industrial instruments irrespective of advice you have received from any source.
Our pay tools are up-to-date and our policy is to continually review the information including pay rates for changes and accuracy. It is reasonable for an employer to rely upon the information on this site as satisfying their workplace relations obligations, provided the questions on the site have been answered accurately and they otherwise have no reason to believe the information to be incorrect.
If you rely upon the information on this site, it is important that you understand that terms and conditions of employment, such as minimum rates of pay, do and will change in the future and the site will be updated to take these into account. Because of this, employers should always subscribe to the pay rate updates for the awards that apply to them.
The Fair Work Ombudsman will not pursue an employer for penalties for breaches of the Fair Work Act if they reasonably relied upon information provided on our website and took appropriate steps to ensure that the information remained current.
Do pay rate update alerts include variations to modern awards made by Fair Work Australia?
From 1 January 2012 the pay rate update alerts include variations to modern awards made by Fair Work Australia. Prior to 1 January 2012 the alerts provide information on updates identified by the Fair Work Ombudsman.
