Is there a dispute in your workplace?

You must follow any dispute resolution procedure in the award or agreement that covers you.

Generally, this will mean trying to resolve it directly between you and your employee(s) in the first instance. If the dispute is not resolved, the dispute resolution procedure may provide that you involve Fair Work Australia (FWA) or another dispute resolution provider to help you try to find a solution.

If the dispute is still not resolved and it involves a contravention of national workplace laws (ie. the laws aren't being complied with) or your award or agreement, you can make a complaint to the Fair Work Ombudsman, who'll investigate the matter.

If the dispute is not covered by your award or agreement Fair Work Australia may still be able to deal with it, for example  if it involves a stand down arising from a disputed right of entry and there is clear power in the Fair Work Act 2009, or where it is provided for in a written contract of employment or other agreement.
